1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and PFDesk Technologies Pvt Ltd ("PFDesk", "we", "us", "our"), governing your access to and use of the pfdesk.in website and all associated services (collectively, the "Service").
By accessing or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.
We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Use of Service
PFDesk provides an assisted platform to help individuals track, transfer, and recover their Provident Fund (PF) accounts maintained with the Employees' Provident Fund Organisation (EPFO) in India. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes.
You agree that you will NOT:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Provide false, misleading, or fraudulent information, including impersonating another person.
- Attempt to gain unauthorised access to any system, network, or data associated with the Service.
- Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service without our express written permission.
- Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of any software used to provide the Service.
- Use the Service to process PF information on behalf of others without their explicit consent.
- Resell, sublicense, or commercially exploit the Service without a separate written agreement with PFDesk.
We reserve the right to suspend or terminate your access to the Service immediately and without notice if we determine, in our sole discretion, that you have violated these Terms.
3. Account Registration & Security
Certain features of the Service may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@pfdesk.in of any unauthorised use of your account or any other security breach.
You represent and warrant that all information you provide during registration and use of the Service is accurate, current, and complete, and that you will update such information as necessary to keep it accurate.
4. Intellectual Property
The Service and all its contents, features, and functionality — including but not limited to all text, graphics, logos, icons, images, software, and the selection and arrangement thereof — are owned by PFDesk Technologies Pvt Ltd or its licensors and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"PFDesk" and the PFDesk logo are trademarks of PFDesk Technologies Pvt Ltd. You may not use these trademarks without our prior written permission. Nothing in these Terms grants you any right, title, or interest in the Service or its content beyond the limited licence described in Section 2.
PF data retrieved from EPFO on your behalf remains subject to EPFO's own terms and applicable law. PFDesk claims no ownership over your personal PF data.
5. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PFDESK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of any PF data displayed, as this data is sourced from EPFO and is subject to EPFO's own accuracy and availability.
PFDesk is not a financial advisor, legal advisor, or registered intermediary. Information provided through the Service is for informational purposes only and should not be construed as financial, legal, or tax advice.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PFDESK TECHNOLOGIES PVT LTD, ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PFDESK'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 500, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages; accordingly, some of the above limitations may not apply to you.
7. Indemnification
You agree to indemnify, defend, and hold harmless PFDesk Technologies Pvt Ltd and its directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any content you submit through the Service.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.
Before initiating any formal legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at support@pfdesk.in. We will attempt to resolve the dispute within 30 days of receiving your notice.
9. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may discontinue use of the Service at any time. To request deletion of your account and associated data, email us at support@pfdesk.in.
